Markavy is a technology platform that helps users discover, request, and book sports and event venues. We provide software tools, including AI-driven automation, to facilitate bookings between users and venue owners.

Markavy is not a venue owner or event organizer. We do not own, operate, or control venues listed on the platform, and we are not a party to agreements between users and venue owners, except as explicitly stated in these Terms.

You must be at least 18 years old to use the Services. By using Markavy, you represent that you have the legal authority to enter into these Terms.

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activity that occurs under your account

Markavy is not responsible for unauthorized access resulting from your failure to safeguard your login information.

4.1 Booking Requests and Confirmations

Some venues allow instant booking, while others require venue approval.

• A booking is not confirmed until you receive explicit confirmation through the platform
• Venue availability and approval decisions are determined by venue owners, not Markavy

4.2 Payments

Payments are processed through third-party payment providers.

• Markavy does not store full payment card details
• You authorize Markavy and its payment providers to charge applicable fees for confirmed bookings

4.3 Fees

Platform fees, if applicable, will be disclosed before payment.

• All fees are non-refundable unless otherwise stated in a venue's cancellation policy

Cancellation and refund policies are set by individual venue owners and displayed during the booking process.

Markavy does not guarantee refunds and is not responsible for enforcing venue-specific refund policies beyond facilitating communication and payment processing as applicable.

If you list a venue on Markavy, you agree to:

• Provide accurate availability, pricing, and rules
• Honor confirmed bookings made through the platform
• Comply with applicable laws, regulations, and safety requirements

Venue owners are solely responsible for their venues, services, and interactions with users.

Markavy uses AI-powered systems and agents to:

• Interpret availability and booking rules
• Automate workflows, notifications, and approvals
• Improve platform efficiency and user experience

While we strive for accuracy, AI-generated outputs may contain errors or limitations. You acknowledge that:

• AI features are provided "as is"
• Final booking decisions and confirmations rest with users and venue owners

You agree not to:

• Use the Services for unlawful purposes
• Misrepresent information or impersonate others
• Attempt to interfere with platform security or functionality
• Circumvent fees or booking workflows

Markavy may suspend or terminate accounts that violate these Terms.

All content, software, and materials provided by Markavy—including trademarks, logos, and platform technology—are owned by Markavy or its licensors.

You may not copy, modify, distribute, or reverse engineer any part of the Services without prior written consent.

The Services may integrate with or link to third-party services. Markavy is not responsible for third-party content, policies, or practices.

Your use of third-party services is governed by their respective terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

MARKAVY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MARKAVY DOES NOT GUARANTEE:

• Venue availability
• Booking approval
• Uninterrupted or error-free service

To the maximum extent permitted by law:

• Markavy shall not be liable for indirect, incidental, or consequential damages
• Markavy's total liability shall not exceed the amount you paid to Markavy in the six (6) months preceding the claim

Markavy is not responsible for disputes, damages, or losses arising from venue use or events.

You agree to indemnify and hold harmless Markavy from claims, damages, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your interactions with other users or venues

Markavy may suspend or terminate your access at any time for violation of these Terms or for operational or security reasons.

You may stop using the Services at any time.

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
